SC withdraws TRO vs Torre De Manila


The Supreme Court withdrew the issued Temporary Restraining Order against the construction of Torre De Manila

During an En Banc session, majority of the Supreme Court judges voted against the petition of the Knights of Rizal last 2014, seeking for the demolition of the ‘Pambansang Photobomber’, because it allegedly ruins the sight-line of the Rizal monument in Luneta Park.

However, with the high court’s decision to withdraw the TRO issued against the said building, there is no legal impediment prohibiting for the construction of Torre De Manila’s high rise condominium.

The petition of the Knights of Rizal was based on Article 14 of the Constitution, stating the responsibility of the state to protect historical and cultural landmarks, including that of the Rizal monument.

DMCI Homes, local government of Manila, National Commission for Culture and the Arts, National Museum and National Historical Commission of the Philippines were the respondents of the said filed by the Knights of Rizal.
