Dean Nilo Divina of the University of Santo Tomas has filed a libel case against the estranged wife of Commission on Elections (COMELEC) Andres Bautista, and his third libel case against her legal counsel, Attorney Lorna Kapunan.
According to Divina, Kapunan and Mrs.Bautista are liable for 16 counts of libel under the Cybercrime Prevention Act. He added that the duo has caused irreversible damage to his image after they publicized a complaint filed against him which were filled with false and defamatory allegations.
Divina explained that Kapunan and Mrs. Bautista also presented copies of the complaint to journalists after filing it before the Supreme Court.
On Monday Divina said that he will be seeking a Php 120 million damage suit against Mrs. Bautista and her legal counsel in two separate complaints.
Divina is seeking Php 50 million in moral damages and another Php 10 million as exemplary damages against Mrs. Bautista due to the false and “malicious” public allegations which accused his law firm, Divina Law Office, of giving commissions to the COMELEC Chief for cases in the commission that they handled.
Divina also seeks Php 60 million for damages against Kapunan after the lawyer linked him in the hazing case of UST freshman law student Horacio Castillo III.
