Operator of Harbour Point Terminal wants CA justice to inhibits self from Harbour case

A Court of Appeals Justice is being asked to inhibit self from the participating in the Harbour Centre Port Terminal case in Manila.

Based on the urgent motion filed at the CA 15th division, Cyrus Paul Valenzuela, president of One Source Port Support Services, stated that Associate Justice Noel Tijam should inhibit himself from the petition case filed by businessman Reghis Romero II.

Romero had asked the CA to issue a Temporary Restraining Order and Writ Of Preliminary Injunction against the decision of the Pasig Regional Trial Court regarding his ownership in Harbour Centre.

Valenzuela insisted that Romero and Associate Justice Tijam have a close relationship and it the case will be tainted if the latter will be in-charge of the said case.

Valenzuela added that Tijam favoring Romero is obvious during its previous decision on the R2 Builders, owned by Romero, against the home Guaranty Corporation and National Housing Authority regarding the Smokey Mountain project which was previously junked by the Manila Regional Trial court because of Romero’s failure to pay the docket fees.

Prior to this, Romero already filed the said case at the Appellate Court, and later on Tijam reversed the decision of the lower court, favoring Romero.

However, based on the last ruling of the Supreme Court, it reversed the decision of the CA because of error upon error.

Because of this, the Group Against Plunder and Kapisanan Kontra Korap continue to be against Associate Justice Tijam.  (Aly Narvaez)
