Group seeks help from Supreme Court to stop TRO in favor of ERC officials

Supreme Court of the Philippines

The Alyansa Para sa Bagong Pilipinas is appealing for the Supreme Court to stop the Temporary Restraining Order that will freeze the suspension order against four commissioners of the Energy Regulatory Commission (ERC).

According to the petition for certiorari filed by the group, the TRO should be declared null and void since the Court of Appeals 9th Division committed grave abuse of discretion.

ABP also said that the CA had no jurisdiction when the TRO was issued.

Previously, the Office of the Ombudsman suspended ERC chairman Jose Vicente Salazar and Commissioners Alfredo Non, Gloria Victoria Yap – Taruc, Josefina Patricia Asirit, and Geronimo Sta. Ana.

The suspension is due to alleged anomalies in the electric supply agreement with 38 companies, since seven of the said corporations were suspected to having connections with the Manila Electric Company (MERALCO).

Last February, the Court of Appeals temporarily halted the suspension since it could affect the work of the ERC due to lack of officials to replaced the supposed suspended officials.
