The Court of Appeals issued a Temporary Restraining Order against the order of the National Telecommunications Commission to all Telecommunications company to refund the extra amount they charged their consumers from text messaging.
The CA Sixth Division issued the said TRO amid the petition filed by Digitel Philippines Inc.
The Appelate Court particularly prohibits the implementation of the November 3, 2012 and May 7, 2014 orders by the NTC commanding a refund from telcos on their excess sms rate.
Prior to this, the NTC ordered an additional 20 centavos refund per “off-network” sms as part of the telcos disobedience on NTC’s memorandum circular that was issued in October 2011.
According to the said memor, consumers should only be charged 80 cents per sent off-net text message.
The TRO will last for 60 days and will only take effect when DIGITEL pays its five hundred thousand peso bond.
